Appeal Court orders ASUU to call of strike

CHIGOZIE IKPO, Abuja 

The Court of Appeal, Abuja, has ordered members of the Academic Staff Union of Universities (ASUU) to call of their strike action and resume work immediately.

The appellate court gave the order in a ruling on an application by ASUU seeking permission for it to appeal against the order of the National Industrial Court (NIC), which asked the striking lecturers to resume duty.

The Court of Appeal however, granted ASUU permission to file an appeal to the rulling of the NIC, on the condition that the union obeys the ruling of the lower court and calls off the strike immediately pending the determination of the substantive suit.

The 3-man panel led by Justice Hamman Barka, said for ASUU to file it’s notice of appeal within 7 days (with effect from today October 7), it must show evidence that it’s members have resumed work.

The panel held that failure to adhere to the order, will make the appeal incompetent before Court of Appeal.

Recall that The National Industrial Court on Sept. 21, ordered the Union to call off the  strike which has lasted for about 8 months.

The court granted the motion on notice filed by the Federal Government, urging the lecturers to return to classrooms.

The Union however, filled a 14 count appeal for a stay of execution of the judgement of the NIC.
