Ebonyi PDP crisis: Court upholds election of Dr Chukwuma Odii as guber candidate

A Federal High Court sitting in abakaliki the Ebonyi State capital, on Tuesday issued an order of perpetual injunction restraining the Peoples Democratic Party (PDP) from cancelling the outcome of its governorship primary election held on 29th May 2022, that produced Chief Chukwuma Odii.

 

This followed the suit instituted at the court by counsel to Chief Odii, Barrister Mudi Erhenede, seeking the relief of the court for a declaration that the National Chairman/Secretary of PDP, can not upturn the valid decisions of the party NWC and NEC without holding valid meetings of its organs.

 

Delivering judgement in the suit, the Presiding Judge Justice Fatun Riman, declared that the cancellation of the PDP governorship primary election was unlawful, null and void.

 

According to the court, “any purported conduct of Primary election when this suit was pending in court, is of no consequence, null and void and is cancelled”

 

The Plaintiff had sought a declaration that the cancellation or purported cancellation of the Peoples Democratic Party Governorship primary electicn held in Ebonyi State on 29/05/2022 is unlawful, whimsical, capricious, null, void and of no effect in any manner”

 

The plaintiff equally sought a declaration that the National Chairman and the National Secretory

of the Peoples Democratic Party cannot upturn the valid decisions of the National Working Committee and the National Executive Committee

without holding a valid and subsequent meetings of the said organs of the party for that purpose”

 

The Court granted all the reliefs of the plaintiffs in its ruling stating “the judgement entered in favour of the plaintiff as per the reliefs and the originating summons”

 

In an interview, counsel to the Plaintiff Barrister Mudi Erhenede, commended the court for this laudable judgement.

 

He expressed optimism that the Peoples Democratic  party (PDP) would comply with the judgement of the court.
