Ubah appeals sacking from Senate

He said he had already filed a stay of execution on the judgment pending the determination of his appeal at the Court of Appeal in Abuja.

He said, “On Friday, I appealed against the judge’s refusal to set aside the judgment.

“I have also filed an application for stay of execution of the verdict.

“I have absolute confidence that the Court of Appeal will do justice and set aside the judgment.”

Ubah said the FCT High Court lacked the “territorial jurisdiction” to entertain a matter that arose from Anambra South primary election.

He said the case was filed against him in Abuja to ensure that he would not be aware of the proceedings.

The lawmaker said the FCT High Court also lacked jurisdiction as the matter in question was a post-election one already settled by the Election Petitions Tribunal and the Court of Appeal, which both gave him victory against the candidate of the PDP, Chris Uba.

He expressed shock that contrary to Section 285(13)) of the 1999 Constitution, the court granted the wish of Uzoh who was not a candidate in the election and did not go through the entire stages of the election as the winner of the election.
